" Return of Plaint " and " Rejection of Plaint "

Return of Plaint နှင့်စပ်လျဉ်း၍ Order 7 rule 10တွင်ပြ

ဌာန်းထားပြီး Rejection of Plaint ကို Order 7 rule 11

 တွင်အသီးသီးပြဌာန်းထားပါသည် ။

 Return of Plaint မှာ စီရင်ပိုင်ခွင့်မရှိသည့်တရားရုံးတွင်ဆို

လွှာတင်သွင်းလာ၍စီရင်ပိုင်ခွင့်ရှိသည့်တရားရုံးတွင်တင်သွင်းနိုင်

စေရန်ဖြစ်ပါသည် ။

ဆိုလွှာပြန်ပေးပါက တရားသူကြီးက ဆိုလွှာကိုမည်သည့်နေ့ရက်

တွင်လက်ခံရရှိကြောင်း မည်သည့်နေ့ရက်တွင်ပြန်ပေးကြောင်းနှင့်

မည်သည့်အကြောင်းကြောင့်ပြန်ပေးကြောင်းမှတ်ချက်ရေးမှတ်၍

လက်မှတ်ထိုးပေးရပါမည် ။

Rejection of Plaint လုပ်နိုင်သောအချက် ၄ ချက်ကို

Order 7 rule 11 တွင်ပြဌာန်းထားပါသည် ။

 -  It does not disclose a cause of action ,

 -  Proper court fee is not paid ,

 - The plaint is written on insufficiently stamped

    paper ,

 - It is barred by the law of limitation .

The effects.

    အမှုကို reject လုပ်ပါက reject လုပ်သည့်အမိန့်သည် Decree ဖြစ်သဖြင့် အယူခံဝင်နိုင်သကဲ့သို့

 အမှုသစ်စွဲဆိုမှုကိုမပိတ်ပင်သဖြင့်အမှုသစ်လည်းတင်သွင်း

နိုင်ပါသည် ။ ( rule 13 )

       Return လုပ်ခြင်းဖြစ်ပါက အမှုသစ်တင်နိုင်ပြီး မှားယွင်း

အမှုစွဲဆိုသည့်ကာလကိုလည်းကာလစည်းကမ်းသတ်ကာလမှ

နှုတ်ပယ်ခွင့်ရရှိပါသည် ။
